Contractual Guide for Relations between Actors of the National Carbon Market in Colombia

This research explores the national carbon market in Colombia since the expedition of the Carbon tax with the 1819 Law of 2016 and the possibility of this tax not being caused by the passive subject if it compensates for the activity generating the tax. This document analyzes the creation of the national carbon market, shows the importance of the economic sector in figures and subsequently identifies and defines each of the actors involved in the market (project owner, developer, verification and validation organizations, Traders, National Government, Consultants and Taxable Person). Additionally, this research carries out an identification of legal risks from a contractual perspective that is organized into a risk matrix according to their probability of occurrence and impact on the development of the national market. Finally, the work exposes the conclusions and relevant content in a Legal Design proposal to facilitate its review and application.
